In a letter this month, the EPA said that it is investigating a series of complaints that the Texas Commission on Environmental Quality allows developers to evade environmental standards, excludes the public from permitting procedures, and more. The investigation comes after dozens of environmental organizations submitted two separate petitions requesting the EPA to intervene and take over state permits. The Texas Sunset Advisory Commission reviewed the agency last year and found it to be "reluctant regulators," recommending that legislators boost penalties on polluters, expand time for the public to comment in on new permits, and enhance online transparency, among other things. The organizations contend that the state agency, which oversees the federal permitting procedure that controls pollutants, permits developers to claim that their projects will have only modest impacts on waterways and places the burden of proof on the public.
